Who's Down For is operated by Thesis Studio LLC.
By using the App, you agree to the following terms.
1. Description of Service
Who's Down For provides tools to coordinate social plans by allowing organizers to collect availability and interest via SMS and web-based responses.
2. Organizer Responsibilities
Organizers agree that:
- They will only enter the phone numbers of people they know and intend to include in a specific plan.
- They will not use the App for marketing, spam, or unlawful communications.
- They will not upload purchased or third-party contact lists.
Recipients will only receive SMS messages after providing explicit consent by replying to an initial opt-in message. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe, HELP for help, or START to re-subscribe.
3. Acceptable Use
You agree not to:
- Use the App for unsolicited commercial messaging
- Harass or abuse recipients
- Violate applicable laws or telecommunications regulations
4. SMS Delivery
Delivery of SMS messages depends on third-party carriers. We do not guarantee message delivery or timing.
5. Limitation of Liability
The App is provided "as is." To the fullest extent permitted by law, Thesis Studio LLC shall not be liable for indirect, incidental, or consequential damages arising from use of the App.
6. Indemnification
Users agree to indemnify and hold harmless Thesis Studio LLC from claims arising from misuse of the App, including failure to comply with applicable messaging laws and regulations.
7. Governing Law
These Terms are governed by the laws of the State of California.
